MOE Tuition (Teacher Tuition Network) — Terms and Conditions

1. Introduction

These Terms and Conditions (“Terms”) apply to your access to and use of the MOE Tuition Agency website and services. In these Terms, “MOE Tuition Agency”, “we”, “us” and “our” refer to [Teacher Tuition Network]. “You” refers to any person who visits our website, enquires about our services, registers with us, or uses our services.

MOE Tuition Agency is an independent tuition agency and is not affiliated with or endorsed by Singapore’s Ministry of Education.

Please read these Terms before using our website or services. By using them, you agree to these Terms. If you do not agree, please do not use our website or services.

You must be at least 18 years old to register or enter into an agreement with us. A person under 18 may use our services only through a parent or legal guardian, who must accept these Terms and act on the student’s behalf.

2. Our services

We help clients find and connect with tutors for tuition and related educational support. Arrangements may include home tuition, lessons at another agreed location, online tuition, group tuition or homework support.

A person seeking tuition is referred to as a “Client”. A person who registers with us to provide tuition is referred to as a “Tutor”. A Client or Tutor who registers with us or requests or accepts an assignment may also be referred to as a “Member”.

We may update, suspend or discontinue any part of our website or services. We will take reasonable steps to notify affected users when a change materially affects an existing arrangement.

Our role is generally to introduce Clients and Tutors and help coordinate arrangements. Unless an invoice or separate written agreement says otherwise, the Tutor provides tuition directly to the Client. We do not guarantee that a particular Tutor will be available or that a tuition arrangement will achieve a particular academic result.

3. Registration and account security

You must provide information that is accurate, complete and current when you register or make a request. Please update us if your details or requirements change. We may decline or end access to our services if the information provided is materially inaccurate or incomplete.

We may use information about your request to identify suitable Tutors and coordinate an assignment. This may include sharing relevant information with prospective Tutors, such as the subject, level, location, schedule and learning requirements. We will handle personal information in accordance with our Privacy Policy: [insert link].

You are responsible for keeping your account credentials confidential and for activity carried out through your account. Please notify us promptly if you suspect unauthorised access or use.

4. Tutor eligibility and safety

Tutors must provide accurate information about their identity, qualifications, experience and suitability for an assignment. Tutors must promptly notify us if information they have provided changes in a way that may affect their suitability.

A Tutor must not accept or continue an assignment if they have been charged with, convicted of, investigated for, or are subject to a restriction or order concerning abuse, violence, exploitation, sexual misconduct or other conduct that could make them unsuitable to teach or interact with a student. Tutors must disclose any such matter to us promptly.

We may verify information provided by Tutors where reasonably practicable, but we do not guarantee that every statement, qualification or credential supplied by a Tutor has been independently verified. Clients should make any checks they consider appropriate before confirming an arrangement.

Where we reasonably consider it necessary for safety or operational reasons, we may decline, suspend or remove a Tutor, cancel or reassign an assignment, or share relevant information with affected Clients or the appropriate authorities.

5. Rates, commission and payment

All amounts are in Singapore dollars unless stated otherwise. Clients and Tutors are responsible for any taxes or charges that apply to them.

Any rates shown on our website or in our communications are indicative unless confirmed in writing. The applicable rate, lesson duration, schedule, payment arrangements and any agency commission or administrative fee will be set out in the assignment confirmation or invoice. The arrangement is confirmed when the relevant parties accept those terms.

Commission is based on 50% of the first 4 weeks of lessons unless stated otherwise

Clients must pay invoices by the due date stated on the invoice and keep their payment records. If a payment is overdue, we may send reminders and take reasonable steps to recover the amount due. Where permitted by law and stated in the invoice or a separate agreement, the Client or Tutor responsible for the overdue amount may also be responsible for reasonable recovery costs.

Once an assignment has been confirmed, the agreed tuition rate should not be changed unless the Client and Tutor agree in writing. Any change that affects our commission or fees must also be reported to us and confirmed by us in writing.

Where we collect tuition fees from the Client on the Tutor’s behalf, we will account to the Tutor for the amount due under the confirmed arrangement, subject to any agreed commission, fees, refunds or adjustments. If the Client pays the Tutor directly, the Client and Tutor must still pay any agency commission or other amounts stated in the assignment confirmation.

Tutors must not collect or retain an agency fee that is due to us. If a Tutor receives an amount that should be paid to us, the Tutor must notify us and pay it within three days of our request, unless we agree otherwise in writing.

Clients remain responsible for fees for lessons attended. If a Client has a concern about a lesson or payment, the Client should contact us promptly so we can try to assist.

6. Lessons, changes and cancellations

The confirmed assignment details will state the expected tuition period, schedule, location and other relevant arrangements. If no minimum period is stated, the parties should discuss their expected commitment before the first lesson.

A Client may ask to change the Tutor or end an assignment by contacting us. Fees for lessons already conducted remain payable. If the Client has paid in advance, we will refund any unused balance after deducting amounts properly due under the confirmed arrangement.

If a Client cancels before the first lesson, any administrative or cancellation fee will be the fee stated in the assignment confirmation. If no such fee was disclosed and accepted in advance, we will discuss the matter with the Client before charging one.

Clients should notify both us and the Tutor as soon as possible if a lesson needs to be cancelled or rescheduled. If notice is given less than two hours before the scheduled start time, the Client may be charged up to 50% of the lesson fee, plus reasonable transport costs actually incurred by the Tutor, where this charge was disclosed in the assignment confirmation. We may waive or adjust the charge where the circumstances justify it.

The Client and Tutor should agree any replacement lesson or schedule change and notify us if it affects the assignment, payment or commission. Changes to lesson frequency during the first four weeks must be reported to us.

7. Conduct and ending an account or assignment

Clients and Tutors are expected to communicate respectfully and act professionally. Tutors should arrive on time, provide the agreed lesson duration, give reasonable notice of changes where practicable, and keep parents or guardians appropriately informed of the student’s progress. Abuse, harassment, discrimination, unsafe conduct and dishonesty are not acceptable. If the lessons are cancelled due to professional misconduct, no fees will be made payable.

We may suspend or end an account, decline a request, or cancel or reassign an assignment where reasonably necessary, including where there is a breach of these Terms, non-payment, suspected fraud or unlawful conduct, a safety concern, serious misconduct, or a material failure to meet the confirmed arrangement. Where practicable, we will explain the reason and give the affected person an opportunity to respond.

You may ask us to close your account by contacting us at [insert contact email]. Closing an account does not remove any outstanding payment obligations or affect rights and obligations that arose before closure. We may retain information where required by law or as described in our Privacy Policy.

8. Website information, liability and indemnity

We take reasonable care to keep information on our website accurate and current, but information may change or contain errors. Please contact us if you believe information is incorrect. Tutor profiles and other information supplied by third parties are their responsibility, and we do not guarantee their accuracy or completeness.

Our website and services are provided on an “as available” basis. To the extent permitted by law, we do not guarantee uninterrupted access, error-free operation, or any particular outcome from using the website or engaging a Tutor.

We are an introduction and coordination service. We are not responsible for the teaching methods or conduct of a Tutor, a Client’s conduct, or the outcome of lessons. We may try to help resolve concerns, but the Client and Tutor remain responsible for their direct tuition arrangement and for communicating about it.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so. To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, goodwill or data arising from use of our website or services.

You agree to compensate us for reasonable losses and costs arising directly from your material breach of these Terms, unlawful conduct, or infringement of another person’s rights. This does not apply to the extent that our own negligence, breach of duty or unlawful conduct caused the loss.

Our website may link to third-party websites. We do not control or endorse those websites and are not responsible for their content, availability or privacy practices.

9. Intellectual property

Unless otherwise stated, the content on our website—including text, graphics, logos, images and software—is owned by or licensed to MOE Tuition Agency and is protected by applicable intellectual property laws.

You may access and use the website for personal, non-commercial purposes. You must not copy, modify, distribute, sell or commercially exploit website content without our prior written permission or the permission of the relevant rights holder. You must not remove copyright or ownership notices.

10. Restrictions and obligations

You must use our website and services lawfully and provide information and documents that you are authorised to share. You must not impersonate another person, submit misleading information, interfere with the website, try to gain unauthorised access to accounts or systems, or use the website in a way that disrupts other users.

We may restrict or end access if you breach these obligations or if providing the service would, in our reasonable view, be unlawful or inappropriate.

11. Website rules and conduct

You must not use our website or services to:

  • Break the law or violate another person’s rights.

  • Harass, threaten, abuse, defame, deceive or discriminate against another person.

  • Upload or share content that is unlawful, harmful, obscene or infringing.

  • Impersonate a person or organisation, including our staff or representatives.

  • Distribute malware or interfere with the security or operation of the website.

  • Copy, reverse engineer or attempt to extract the source code of the website, except where applicable law permits this.

  • Use our website or services to advertise or sell unrelated goods or services without our written consent.

We may remove content or restrict access where reasonably necessary to protect users, our services or the rights of others.

12. Communications

We may communicate with you by email, telephone, messaging service or other contact details you provide. You are responsible for keeping those details current and for checking messages about your request or assignment.

If our website provides a forum, chat or other communication feature, you must use it lawfully and respectfully. Do not share another person’s personal information or content unless you have permission to do so. We may review or remove material and restrict access to these features where reasonably necessary.

13. Disputes and governing law

If you have a concern about our services, please contact us first at [admin@teachertuition.com] so we can try to resolve it.

These Terms are governed by the laws of Singapore. Any dispute that cannot be resolved informally will be dealt with by the courts of Singapore, subject to any rights you may have under applicable law.

14. Changes to these Terms

We may update these Terms from time to time. The revised version will be posted on our website with its effective date. If a change materially affects an existing assignment, we will take reasonable steps to notify the affected parties. Continued use of our website or services after the revised Terms take effect means you accept the revised Terms.

These Terms, together with any assignment confirmation, invoice, privacy policy or other document expressly incorporated into them, form the agreement between you and us concerning the relevant website or services. If there is a conflict, the assignment confirmation will govern the specific assignment, and these Terms will govern general website and service use.
